I’ve written this piece for Just Security. It discusses two features of the effort to have Samuel Tilden prevail in the disputed election of 1876, one from South Carolina and the other from Vermont, both of which lacked any official imprimatur from the state’s government. Consideration of these historical precedents is useful when comparing the effort by Trump supporters to have rival submissions of electoral votes from several states derail the recognition of Joe Biden’s victory in the January 6 joint session of Congress.
